HOJA for Influencer Terms of Service

1. About these Terms

These Terms govern your use of HOJA for Influencer (https://influencer.hoja.vn and the HOJA for Influencer apps, the "Service"), operated by CÔNG TY TNHH LN PARTNERS (tax code 0316801398). By creating an account or using the Service you agree to these Terms and to the Privacy Policy.

2. Who can use the Service

• You must be at least 18 years old and have full civil capacity to sign collaboration contracts.
• One person may hold one creator account. Accounts cannot be sold, transferred or shared.
• The information you give us — name, contact details, channels and, when you sign a contract, identity and bank details — must be true and your own.

3. Your account

• You can sign up with email and password or with Google, Facebook, TikTok or Apple. Keep your sign-in details secret; you are responsible for activity under your account.
• If you created two accounts, you can merge them after proving you control both. Signing in with either one then opens the same creator account.
• Tell us at [email protected] if you suspect someone else is using your account.

4. Connected channels and verification

• Connect only social accounts you own or are authorized to manage. Verification happens through each platform's official login; a channel verified by one HOJA account cannot be verified by another at the same time.
• We read only the data described in the Privacy Policy and never post on your behalf.
• You can disconnect a channel at any time. Brands then stop seeing it as verified.
• Your use of each platform remains subject to that platform's own terms.

5. Campaigns and contracts with brands

• Brands publish campaigns and choose creators at their own discretion. Applying does not guarantee selection.
• The collaboration contract (scope, deadlines, fees, usage rights, confidentiality) is concluded directly between you and the brand. HOJA provides the tools to manage it and is not a party to that contract.
• Contracts can be signed electronically in the Service. Electronic contracts and signatures have legal effect under the Law on Electronic Transactions No. 20/2023/QH15.
• To sign a contract you provide identity, tax and bank information with separate consent, as described in the Privacy Policy.

6. Your content and advertising rules

When you promote a product or service you are an advertising content deliverer under Article 15a of the Law on Advertising No. 16/2012/QH13, as amended by Law No. 75/2025/QH15. You must:

• clearly disclose that the content is an advertisement or paid collaboration;
• only introduce or review products and services you have actually used, and not make claims you cannot support;
• for cosmetics, health supplements, medical devices and other specially regulated products, check the brand's legal documents (such as product announcements and advertising content confirmations) before publishing;
• provide advertising documents to competent authorities on request, and fulfil your tax obligations on advertising income.

You keep ownership of your content. The rights a brand receives to use it are set in your contract with that brand. You grant HOJA a non-exclusive licence to store and display the content you submit inside the Service to operate the campaign and show results to the brand.

Content must not infringe others' rights, be misleading, hateful, sexual, violent or otherwise unlawful under Vietnamese law or the rules of the platform where it is published.

7. Payments and taxes

• Fees are set in your contract with the brand and paid by the brand. The Service records payment status and receipts; HOJA does not hold creator funds.
• Under the Law on Personal Income Tax No. 109/2025/QH15 and Article 50(2) of Decree 253/2026/NĐ-CP, an organization paying a resident individual without a labour contract withholds 10% personal income tax on each payment of 5,000,000 VND or more. Creators registered as household businesses that issue invoices follow their own tax regime.
• You are responsible for the accuracy of your tax code and bank details. Payments to an account you entered incorrectly may not be recoverable.

8. Product seeding

If a brand sends you products, confirm receipt in the Service. Whether you keep or return products is governed by the campaign terms. Give a delivery address you are entitled to use.

9. What you must not do

• Buy or fake followers, views or engagement, or submit statistics that are not real.
• Impersonate another person or connect a channel you do not control.
• Contact brands through the Service to avoid a contract you have already accepted, or to solicit off-platform payments in breach of a campaign's terms.
• Scrape, reverse-engineer or overload the Service, or access other users' data.
• Upload malware or content you have no right to share.

10. Reviews and rankings

Brands may rate completed collaborations. The leaderboard shows creators only under a masked name with aggregated metrics. Ratings must reflect real collaborations. You can report a review you believe is false; we review reports but do not guarantee removal.

11. Suspension and account deletion

• We may restrict or suspend an account that breaches these Terms or the law, after notice where practicable. Serious breaches may lead to immediate suspension.
• You can delete your account at any time (Profile > Account > Delete account on the web, Me > Delete account in the app). Obligations under contracts already signed with brands continue.

12. HOJA's rights

The Service, its software, design and trademarks belong to LN PARTNERS or its licensors. These Terms do not grant you any right to them beyond using the Service.

13. Liability

We work to keep the Service available and accurate but provide it as is. Statistics come from the platforms and may be delayed or change. To the extent permitted by Vietnamese law, HOJA is not liable for indirect losses or for a brand's performance of its contract with you. Nothing in these Terms limits rights you have under the Law on Protection of Consumer Rights No. 19/2023/QH15 or other mandatory law.

14. Changes

We may update these Terms. We show the version and effective date at the top of this page and notify you in the Service at least 7 days before a material change takes effect. If you do not agree, you can stop using the Service and delete your account.

15. Governing law and disputes

These Terms are governed by the laws of Vietnam. Disputes are first resolved by negotiation; if that fails within 30 days, either side may bring the dispute to the competent court in Ho Chi Minh City. If language versions differ, the Vietnamese version prevails.
